Details of the Construction Employability Award

The Construction Employability Award (the Award) is a £25,000 grant awarded at the discretion of the trustees of the Construction Workers’ Charitable Trust to a training organisation or company involved in accredited training that makes a significant difference to the Construction Industry.

In these terms and conditions Charitable Trust, we, us and our means the Construction Workers’ Charitable Trust (registered charity number 1004732).

Acceptance of these terms and conditions

These terms and conditions apply only to the Award application and assessment process. They are not an offer of funding and do not guarantee that you will receive a grant. If your application is successful, the grant will be subject to separate grant terms and conditions that you must accept.

By applying for the Award, you are confirming that you accept these terms and conditions, and you agree to comply with them. You are also confirming your acceptance of the following additional terms: our website terms and conditions; and our Privacy Policy.

We may make changes to these terms

We may amend these terms and conditions without notification. The terms and conditions that apply are those in place at the date you submit your application.

How to apply

Eligibility Criteria

You must be an organisation registered and based in the United Kingdom which aims to promote health and safety and/or training in the construction industry that leads to employment. You must not be a government organisation, or funded by or linked to a government organisation.

Application Criteria for the Award

You must demonstrate how your project/initiative will:

• make a significant difference to the construction industry;
• benefit a minimum of 15 individuals within a one-year period (which, for the purposes of the application, this period is to begin no later than 6-9 months of when you submit your application); and
• provide recognised construction industry accreditation; and
• offer training that is linked to any employer or placement in the UK and will benefit individuals in gaining hands-on experience and the ability to find future employment.

When you submit your application you are confirming:

• the information you provide is true, accurate, complete and not misleading.
• you have declared any other funding you have obtained for your project/initiative and disclosed any potential conflicts of interest.
• any confidential or commercially sensitive information in your application has been identified.
• your application and supporting materials do not infringe anyone else’s rights and you have obtained any permissions needed for us to review, use and publicise the application as set out in these terms and conditions.

You must not act improperly in connection with the Award. We may reject an application or withdraw an offer if we have concerns about fraud, bribery or other unlawful conduct.

Material changes in your application

You must inform us as soon as possible if there have been any material changes in the circumstances detailed in your application. Wherever possible, you should notify us of these changes before they occur.

The Award application process

1. Read our handy checklist to make sure you have everything ready before you apply.
2. Ensure you meet the eligibility and application criteria for the Award before submitting your application.
3. Complete the online application form. It is not possible to save the application as you go, so make sure you have all the information to hand before you start the application.
4. Make sure you submit your application before the closing date. Once we’ve received your application, you will receive an email confirming if your entry has been received prior to the closing date.
5. After the closing date, we will review all applications received. As part of this process, we may carry out other relevant due diligence checks and also consider any other relevant factors.
6. We will review all applications and decide whether to make an Award. Our decision is final and there is no right of appeal. We do not guarantee that any Award will be made and may change the process, extend the closing date or withdraw an offer at any time.
7. We will email you to let you know if your application has been successful or not.
8. If your application has been successful, we will notify you and provide you with a grant offer (which will include the grant terms and conditions and payment details) for your agreement.
9. We may withdraw or amend a grant offer should we subsequently consider any of the criteria are not met, if the grant terms and conditions are not accepted or if we become aware of any matter that would have affected our decision to make the Award.

Intellectual property

You keep ownership of your application and supporting materials. By submitting an application, you allow us to use, copy, store, assess and share those materials as needed to manage, assess and publicise the Award.

We do not authorise you to use any of our registered trademarks and you are not permitted to use them without our prior written approval.

Publicity

We may publicise (for example, in any promotional material or the results of the Award) your application or its content using your name, videos, photographs and logo and any information gathered from your application or provided in support of your application (including quotes and/or photographs and/or videos in your application but excluding the confidential and commercially sensitive information you have identified in your application).

Use and collection of personal data

We will process personal data provided as part of an application in accordance with our privacy policy and applicable data protection legislation, for assessing application purposes and making Awards and to publicise successful applications. You must ensure that any personal data you provide has been collected and shared lawfully, and that relevant individuals have been given appropriate privacy information. You should not include special category or criminal offence data unless we request it or it is strictly necessary.

Limitation of liability and indemnity

We accept no liability for any consequences, whether direct or indirect, that may come about from your application, our processing or consideration of it and any decision made in respect of your application.

We accept no responsibility for lost, corrupted, delayed or mislaid applications.

You agree to indemnify us against all liabilities, damages, losses (including loss of reputation), expenses and costs (including all interest, penalties, legal costs (calculated on a full indemnity basis) and professional costs and expenses) suffered or incurred by us in connection with your application as a result of: your acts or omissions in relation to your application or these terms and conditions; your non-fulfilment of any obligations under these terms and conditions; or your performance or non-performance of any obligation to any third party in relation to your application.

Severance

If any provision of these terms and conditions (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision (or remaining part provision) of these terms and conditions shall not be affected.

Third party rights

A person who is not a party to these terms and conditions may not enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

Jurisdiction

The validity, construction and performance of these terms and conditions and all contractual and non-contractual matters arising out of them, shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
