Details of the The Construction Employability Award

The Construction Employability Award (“the Award”) is a £20,000 grant awarded to a training organisation or company involved in accredited training, who makes a significant difference to the Construction Industry.

The process leading to any Award shall be governed by these terms and conditions.

The Award is made entirely at the discretion of “the Board”, which is made up of the trustees of the Building & Civil Engineering Charitable Trust (“the Charitable Trust”). The Board’s decision is final, and no correspondence or appeals will be entered into.

Acceptance of terms

By applying for The Construction Employability Award, you confirm that you accept these Application Terms and Conditions, and you agree to comply with them. You also confirm your acceptance of the following additional terms: (i) our website terms and conditions; and (ii) our Privacy Policy.

We may make changes to these terms

We may amend these terms and conditions without notification. Please check these terms regularly to en-sure you understand the terms that apply at that time.

How to apply for the Award

In order to apply for the Award please visit The Construction Employability Award web page. Please read these terms and conditions carefully to ensure you meet both the eligibility and application criteria before applying.

Eligibility Criteria for the Award

You must be an organisation registered and based in the United Kingdom who aims to promote health and safety and/or training in the construction industry.

Application Criteria for the Award

You must be able to demonstrate that:

  • you meet the eligibility criteria;
  • your project/initiative will make a significant difference to the construction industry;
  • your project/initiative will benefit a minimum of 50 individuals within a one-year period (which, for the purposes of the application, is to begin no later than 6-9 months of your application);
  • your project/initiative will provide recognised construction industry accreditation;
  • your project/initiative will offer training that is linked to any employer or placement in the UK and will benefit individuals in gaining hands-on experience and the ability to find future employment;
  • you have declared any other funding you have obtained for your project/initiative; and
  • you are not a government organisation, nor are you funded by or linked to a government organisation.

The Award application process

  1. Ensure you meet the Eligibility and Application Criteria for the Award before submitting your application.
  2. Read our handy checklist to make sure you have everything ready before you apply.
  3. Complete the online application form. It is not possible to save the application as you go, so make sure you have all the information to hand before you start the application.
  4. Make sure you submit your application before the closing date. Once we’ve received your application, you will receive an email confirming if your entry has been received prior to the closing date.
  5. After the closing date, the Board will review all applications received.
  6. You must inform the Board process as soon as possible if there have been any changes in the circumstances detailed in your application. Wherever possible, you should notify the Board of these changes before they occur. 
  7. We will email you to let you know if your application has been successful or not.
  8. If your application has been successful, we will you with a Grant Offer. This Grant Offer will set out the details for the payment of the Award and requires your acceptance of the general Grant terms and conditions.
  9. The Award will only be confirmed subject to the Grant Acceptance Form being fully executed by you and us.  
  10. If the Board becomes aware there has been changes in the circumstances detailed in your application before the Grant Acceptance Form is executed, the Board reserves the right to reconsider any decision it has made to make an Award (including, but limited to, withdrawing or modifying any Award).  

Intellectual property

Copyright in the content of your application will pass to us as soon as submitted. We shall have an exclusive, irrevocable, worldwide licence to publish, syndicate, distribute, reproduce and exploit the material in all present and future media and formats and to sub-license these rights to others.

We do not authorise you to use any of our registered trademarks and you are not permitted to use them without our prior written approval.

Publicity

Where we have provided written consent for you to use our trademarks, you must comply with all the Charitable Trust’s branding guidelines issued when using these trademarks.

We may publicise (for example, in any promotional material or the results of the Award) your application or its content using your name, videos, photographs and logo and any information gathered from your application or provided in support of your application (including quotes and/or photographs and/or videos in your application).

Use and collection of personal data

We will only use your personal data as set out in our privacy policy.

The following definitions apply in relation to the use and collection of personal data:

Data Protection Legislation” means all applicable law relating to data protection, the processing, privacy and use of personal data, and e-privacy, including the Data Protection Act 2018 and any associated regulations or instruments (the “DPA”); the GDPR; the Privacy and Electronic Communications (EC Directive) Regulations 2003 (as amended) as may be replaced by applicable law giving effect to the proposed EU Regulation on Privacy and Electronic Communications; and any legally binding guidance, guidelines, codes of practice and codes of conduct issued by the Information Commissioner from time to time;

GDPR” means Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons, with regard to the processing of personal data and on the free movement of such data as it forms part of the law of England and Wales, Scotland and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018 and the Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019 as amended by the Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2020.

The Charitable Trust and the applicant will each remain a controller in respect of the personal data and shall independently determine the purposes and means of such processing and each shall comply with Data Protection Legislation in relation to its processing of personal data.

Terms of the Award

Our decision shall be final and is not open to appeal.

We may, in our sole and absolute discretion, declare void any application or withdraw the Award should we consider that there are no entries reaching the required standard.

We shall have the right, in our sole and absolute discretion, and without notification, to change the rules including the extension of the closing date.

No correspondence will be entered into, or comment issued on any matters concerning the Award, nor are we required to give any reasons for any decision made.

We do not guarantee the success of any application, and we may suspend or withdraw any offer for any reason.

We may ask applicants to supply further information.

You are responsible for ensuring that you meet the terms and conditions contained in this agreement when making your application for the Award. We accept no responsibility for lost, corrupted, delayed or mislaid applications.

If the grantee is not able to take up the Award for any reason, we may at our sole and absolute discretion decide whether to make the Award to an alternative grantee and the original grantee will not then be eligible to take up the Award.

Limitation of liability and indemnity

We accept no liability for any consequences, whether direct or indirect, that may come about from your application, our processing of it and the Board’s consideration of it and any decision made in respect of your application.

You agree to indemnify us against all liabilities, damages, losses (including loss of reputation), expenses and costs (including all interest, penalties, legal costs (calculated on a full indemnity basis) and professional costs and expenses) suffered or incurred by us in connection with your application as a result of: your acts or omissions in relation to your application or this agreement; your non-fulfilment of any obligations under this agreement; or your performance or non-performance of any obligation to any third party in relation to your application.

General

The Award is specifically made to the grantee and the grantee shall not assign, charge, subcontract or otherwise attempt to transfer or deal in its interest in the Award or the terms governing it without the prior written consent of the Charitable Trust.

Severence

If any provision of this agreement (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision (or remaining part provision) of this agreement shall not be affected.

Third party rights

A person who is not a party to these terms and conditions may not enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

Which country’s laws apply to any disputes?

The validity, construction and performance of these terms and conditions and all contractual and non-contractual matters arising out of them, shall be governed by the Laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts, to which you and we submit.
